Nokia E71 Phone Giveaway Sweepstakes Official Rules

1. NO PURCHASE NECESSARY. PURCHASE WILL NOT ENHANCE CHANCES OF WINNING.

2. ELIGIBILITY: The Nokia E71 Phone Giveaway Sweepstakes (the "Sweepstakes”) brought to you by Nokia Inc. (the "Sponsor”) is governed by these “Official Rules”. The Sweepstakes is open to legal residents of the 50 United States and the District of Columbia who are thirteen (13) years of age or older. Void where prohibited. Sponsor reserves the right, at any time, to verify eligibility requirements, in any manner it deems appropriate. Employees and directors of Sponsor, its parent, subsidiary, and affiliated companies, licensees, advertising, promotion or production agencies and provider companies (and their immediate family members and individuals residing in their same household) are not eligible. All entries become the exclusive property of Sponsor.

3. THE SWEEPSTAKES PERIOD: The Sweepstakes begins at 12:00:01 a.m. (midnight) Central Time (CT) on October 10, 2008 and concludes at 11:59:59 p.m. CT on November 30, 2008 (the “Sweepstakes Period”). The computer of the Sponsor is the official timekeeping device for this Sweepstakes. All entries must be received and recorded by Sponsor’s computer during the Sweepstakes Period.

4. TWO WAYS TO ENTER: Visit http://www.nokiausa.com/E71sweeps (“Web site”) during the Sweepstakes Period and click on the Sweepstakes icon, banner or text link(s) to access the Sweepstakes registration page. Follow the online instructions to register by providing your name, complete address, age, daytime phone number, date of birth and email address to enter the sweepstakes. (b) Or, click on the link within the promotional email you may have received from the Sponsor during the Sweepstakes Period. The link will take you to the registration page where you will be required to provide your name, complete address, age, daytime phone number, and email address to enter the Sweepstakes. Participants may opt to receive email communications from Nokia. Participants can be removed from the email communications at any time by following the online instructions. Opting to be removed from the email communications will not affect chances of winning. No other form of entry is valid. Limit one (1) entry per person/email address per day.

5. DRAWING: Winners will be selected in a random drawing held on or about December 4, 2008 from all eligible entries received by an independent judging agency, whose decisions are final and binding in all matters relating to this Sweepstakes. Winners will be notified by phone, mail or email on or about December 10, 2008. Limit one (1) prize per person/address/ household.

6. PRIZE DETAILS/ODDS: Prizes (3): Winner will receive a Nokia E71 device. Approximate Retail Value (ARV) $483.00 each prize. Winner must accept prize as specified by Sponsor or prize will be forfeited and awarded to an alternate winner. Odds of winning depend on the number of eligible entries received. Prize cannot be assigned, transferred, redeemed for cash, or substituted except by Sponsor who may, at its sole discretion, substitute any prize with one of comparable value if the advertised prize becomes unavailable for any reason. Total ARV of all prizes: $1,449.00.

7. CONDITIONS OF PARTICIPATION: Participants agree (a) to these Official Rules and the decisions of Sponsor which are final and binding, (b) that Sponsor, their parent, subsidiary and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents will have no liability whatsoever for, are released and shall be held harmless by participants against any liability for any injuries, losses or damages of any kind to persons, including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Sweepstakes or Sweepstakes-related activities and (c) except where legally prohibited, winner grants (and agree to confirm that grant in writing) permission to Sponsor and those acting under Sponsor’s authority the right to the use of his/her name, photograph, likeness, voice, image and biographical information and statements for advertising, trade, publicity and promotional purposes without additional compensation, in all media now known or hereafter discovered, worldwide and on the Internet and World Wide Web, without notice, review or approval.

8. REQUIRED DOCUMENTATION: Winners may be required to complete, sign, and return an Affidavit of Eligibility, a Liability Release and, where lawful, a Publicity Release within seven (7) days after notification. If documents are not returned on a timely basis, or if any prize notification or prize is returned as non-deliverable, or if winner is found to be ineligible or not in compliance with these Official Rules, such prize will be forfeited and an alternate winner selected. Should a prize be won by a minor (determined by the jurisdiction of primary residence), all affidavits, releases and other documents must be executed by the parent or legal guardian of the minor, on behalf of himself and the minor, or prize may be forfeited and awarded to an alternate winner. Prize may be awarded in the name of, or to, minor winner’s parent or legal guardian. Taxes, if any, on a prize are solely the responsibility of the winner.

9. GENERAL PROVISIONS: Neither Sponsor nor its agencies are responsible for not receiving entries, no matter what the reason even if known in advance, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or the failure to capture any such information. Persons who tamper with any aspect of the Sweepstakes, as solely determined by the Sponsor, or who attempt to participate with multiple email addresses or under multiple identities will be disqualified. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries and disqualify any entrant using such methods. Sponsor is not responsible for injury or damage to computers related to or resulting from participating in the Sweepstakes or use of the Web site. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes, and select the winners from entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. In case of dispute, the authorized subscriber of the e-mail account used to enter the promotion at the actual time of entry will be deemed to be the participant, and must comply with these Official Rules.

10. GOVERNING LAW AND ARBITRATION: This Sweepstakes will be governed by and interpreted under the laws of the State of Texas, without application of any conflicts of law rules. Disputes between the parties or their affiliates related to this Sweepstakes shall be submitted to final, binding arbitration heard by a single arbitrator in accordance with the then-current Commercial Arbitration Rules of the American Arbitration Association (except as modified herein). Any counterclaim not brought within thirty (30) days after receipt of the arbitration notice shall be barred. The arbitration shall be conducted in Dallas County, Texas in English. Unless otherwise specified herein, the arbitrator may award any relief that he deems proper, including but not limited to equitable relief. The award shall be final and binding and enforceable in any court of competent jurisdiction.

11. WINNER’S LIST: For the names of the winners, write your name and address on a 3”x5” card and mail in first-class, stamped envelope to: Nokia E71 Phone Giveaway Sweepstakes Winners List, P.O. Box 4636, Dept. 4602-7075, Young America, MN 55558-4636 for receipt by December 31, 2008.
